Your Rights Under Maryland Lemon Law

If your vehicle has a defect that affects its safety, value, or use, and it cannot be repaired after a reasonable number of attempts, Maryland Lemon Law guarantees your right to compensation, including:

  • Replacement: A new vehicle of the same make and model.
  • Repurchase: A full refund, including taxes and fees, minus a mileage deduction.
  • Cash Settlement: Compensation for the defect’s impact, with potential civil penalties up to three times the original amount.

Additionally, Maryland Lemon Law requires manufacturers to cover attorney fees, allowing you to pursue your claim without financial strain.

What Vehicles Are Covered by Maryland Lemon Law?

Maryland Lemon Law applies to:

  • New and certified pre-owned vehicles under the manufacturer’s warranty.
  • Used vehicles with a remaining factory warranty.
  • Vehicles like cars, trucks, motorcycles, SUVs, RVs, and certain business vehicles (under 10,000 lbs).

Exclusions may apply for minor defects or issues caused by unauthorized alterations or misuse.

How to Qualify for Maryland Lemon Law?

To qualify for Maryland Lemon Law, the defect must:

  • Substantially impair the vehicle’s use and market value, and be reported during the manufacturer’s warranty period — Maryland ties eligibility to the full warranty term itself, with no separate 1-year or mileage cutoff (Md. Code Ann., Com. Law § 14-1502(b)).
  • Survive a reasonable number of repair attempts. Maryland presumes that standard is met when the same defect has been repaired 4 or more times, or the vehicle has been out of service 30 or more cumulative days — both within the warranty period. A brake or steering failure needs only 1 repair attempt (§ 14-1502(d)).
  • If a refund is due, your use allowance is capped at 15% of the purchase price, not a mileage-fraction formula.
  • A lawsuit must be filed within 3 years of the original delivery date (§ 14-1502(k)).

Types of Defects Covered by Maryland Lemon Law

Maryland Lemon Law protects consumers from defects that interfere with the vehicle’s operation or safety, including:

  • Engine failure
  • Braking system failure
  • Electrical malfunctions
  • Faulty airbag systems
  • Transmission issues
  • Steering and suspension defects

These defects must persist despite reasonable repair attempts and be covered under the manufacturer’s warranty.

Lemon Law for Used Cars in Maryland

Maryland Lemon Law applies to used vehicles under the following conditions:

  • The defect must still be covered by the original manufacturer’s warranty.
  • It must significantly affect the vehicle’s safety, value, or use.
  • The defect must remain unresolved after reasonable repair attempts.

If your used vehicle qualifies, we can help you pursue compensation.
