What Vehicles Are Covered?

Texas Lemon Law covers a variety of vehicles, including:

  • New vehicles such as cars, trucks, motorcycles, ATVs, and motor homes.
  • Towable RVs and demonstrator vehicles.
  • Leased vehicles still under the manufacturer’s warranty.

Used vehicles might also qualify if the defect was reported while the original manufacturer’s warranty was still valid.

Reasonable Repair Attempts

Your vehicle may be considered a lemon if one of the following conditions is met within 24 months or 24,000 miles, whichever comes first:

  • 2 Attempts for Safety Issues: Safety-related defects persist after two repair attempts.
  • 4 Attempts: The defect remains unresolved after four repair attempts.
  • 30 Days Out of Service: The vehicle has been out of service for repairs for a total of 30 days or more.

Filing a Texas Lemon Law Complaint

To ensure eligibility under Texas Lemon Law, a complaint must be filed with the Texas Department of Motor Vehicles within six months after the earliest of:

  • The expiration of the express warranty term;
  • 24 months after the date of purchase; or
  • 24,000 miles following the date of delivery (Tex. Occ. Code § 2301.606(d)).
