How to Qualify for Virginia Lemon Law

To qualify for Virginia Lemon Law, the defect must:

  • Significantly impair the vehicle’s use, market value, or safety, and arise during Virginia’s “lemon law rights period” — 18 months from original delivery, with no separate mileage limit (Va. Code Ann. § 59.1-207.11).
  • Survive a reasonable number of repair attempts. Virginia presumes that standard is met when the same defect has been repaired 3 or more times, or the vehicle has been out of service 30 or more cumulative days — both within that same 18-month period. A serious safety defect needs only 1 repair attempt to trigger the presumption (§ 59.1-207.13(B)).
  • A lawsuit generally must be filed within that same 18-month rights period itself — one of the shortest windows in the country. If you first pursue the manufacturer’s informal dispute process, you get 12 months from its final decision instead, if that is longer (§ 59.1-207.16).
